Lake Wales Damage Complaints Go to Commission

Residents who claim their homes were damaged when a vibrating compactor was used during construction of a rails-to-trails project will take their complaints back to the City Commission when it meets at 6 tonight in City Hall.

Brian Baily, a spokesman for the Merlin Law Group, which represents about 20 residents, said the residents have been unable to receive satisfaction from Lane Construction.

Baily said Lane Construction officials have offered the residents about $2,500 a piece, but damages range from $5,000 to $7,000.

After Liberty Mutual, which represents Lane, initially rejected the residents claims, Liberty Mutual officials promised city commissioners that they would resolve the issue.

While it was not a city project, city officials have attempted to assist homeowners since the damage was reported last fall during construction of the $795,000 trail, which extends from Fourth Street to a point east of Tower Boulevard.
